Himachal Pradesh Passes Law: No Pension for MLAs Who Switch Parties

On Wednesday, September 4, the Himachal Pradesh Assembly approved a new law to stop MLAs (Members of the Legislative Assembly) from switching parties by taking away their pensions. The law, called the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Amendment Bill 2024, was introduced by Chief Minister Sukhvinder Singh Sukhu.

According to this law, if an MLA is disqualified under the anti-defection rule (which is in the Tenth Schedule of the Constitution), they will lose their right to get a pension. The law also allows the government to take back any pension that has already been given to these disqualified MLAs, as per reported by The Indian Express.

Currently, MLAs in Himachal Pradesh who serve for up to five years can get a monthly pension of Rs 36,000. For each extra year after their first term, they receive an additional Rs 1,000. The anti-defection law, which was introduced in 1985, is meant to stop MLAs from changing parties for personal gain.

In February, six Congress MLAs in Himachal Pradesh were disqualified under this anti-defection law because they didn’t follow their party’s orders during budget discussions.

In recent years, states like Karnataka, Maharashtra, and Madhya Pradesh saw governments fall because some MLAs switched parties, leading to the removal of non-BJP (Bharatiya Janata Party) governments.
